These Terms of Use (“Terms”) govern your access to and use of the BA Light Wellness™ website, Body Notes™ (the “Tool”), and related services including Practitioner Review (Basic and Advanced) (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

If you do not agree, do not use the Services.

2) Scope of Services

2.1 Educational + Documentation Tool Only

BA Light Wellness™ provides educational information and structured body-signal documentation tools. Body Notes™ is designed to support objective observation, recordkeeping, and continuity-of-care communication for individuals, families, caregivers, and professionals.

2.2 Not Medical Advice

The Services do not provide medical advice. Nothing on this website or within Body Notes™ is a substitute for evaluation, diagnosis, or treatment by a licensed medical provider.

2.3 No Diagnosis, Treatment, Prescribing, or Emergency Services

We do not diagnose conditions, treat disease, prescribe medications, interpret testing as a medical provider, or provide emergency or urgent care services.

2.4 Not Emergency Services

Body Notes™ is not an emergency tool and is not monitored for emergencies. If you have urgent or life-threatening symptoms—such as chest pain, difficulty breathing, stroke-like symptoms, severe abdominal pain, fainting, uncontrolled bleeding, or any immediate danger—call 911 or go to the nearest emergency department.

 

3) Eligibility and User Responsibilities

By using the Services, you represent that you are at least 18 years old (or using the Services with legal guardian permission and supervision) and that you will use the Services lawfully and responsibly.

You are responsible for:

• the accuracy and completeness of information you enter into Body Notes™ or provide for review

• seeking licensed evaluation and care when needed

• not delaying or avoiding medical evaluation based on information from the Services

If you are documenting for another person (child, elder, patient/client), you are responsible for having legal authority and for complying with applicable privacy laws, professional requirements, and facility policies.

 

4) Access, Third-Party Platforms, and Acceptable Use

4.1 Third-Party Access and Hosting

Body Notes™ and purchasing/booking features may be delivered through third-party platforms (including Leap and related tools). Availability, performance, and data handling may be governed in part by those third-party providers’ terms and privacy practices.

4.2 Acceptable Use

You agree not to:

• use the Services for unlawful, fraudulent, or harmful purposes

• attempt to access systems or data you are not authorized to access

• upload malicious code or interfere with platform performance

• misrepresent your identity or authority to document for another person

• scrape, copy, reproduce, resell, or distribute the Services or Materials (defined below)

We may restrict or terminate access if we believe your use violates these Terms, creates risk, or harms the platform or others.

5) Purchases, Payment Processing, and Digital Delivery

5.1 One-Time Digital Purchase (Non-Refundable)

Body Notes™ is a one-time, non-refundable digital purchase. By completing purchase, you acknowledge that you are receiving access to a digital product/tool and that all sales are final.

5.2 Payment Processing

Payments may be processed through third-party providers, including Leap and its connected payment processors. Your purchase may be subject to the provider’s separate terms and privacy practices. You agree to provide accurate billing information and authorize charges associated with your purchase.

6) Practitioner Review (Basic + Advanced) — Service Terms

If you purchase a Practitioner Review (Basic or Advanced), you acknowledge and agree:

6.1 What Practitioner Review Includes

Practitioner Review is documentation-focused support only, which may include:

• review of completeness and organization of your documentation

• identification of missing objective details (timing, frequency, severity, functional impact)

• communication-ready formatting suggestions to support continuity-of-care communication

• a written review plus a scheduled call

6.2 What Practitioner Review Does Not Include

Practitioner Review does not provide diagnosis, treatment, prescriptions, triage, emergency guidance, or medical decision-making and does not establish a doctor–patient relationship.

6.3 Scheduling and Turnaround

Scheduling is completed through booking tools available within the Leap creator store (including Book My Time). Standard turnaround for Practitioner Review deliverables is 3 to 5 business days, not including weekends or holidays, unless otherwise stated at time of purchase/booking.

6.4 Not Emergency Services

Practitioner Review is not an emergency service and is not appropriate for urgent or worsening symptoms. If emergency symptoms are present, seek emergency services immediately.

 

7) Service Availability and Modifications

The Services may be updated, modified, suspended, or discontinued in whole or in part to maintain platform integrity, comply with law, or improve performance. We do not guarantee uninterrupted access or error-free operation

 

8) Intellectual Property Notice

All content, documentation formats, templates, frameworks, tools, training materials, written content, graphics, designs, downloads, and product assets associated with Dr. Clara Ray, BA Light Wellness™, Body Notes™, Body Literacy™, and any related tools, books, digital products, apps, or services (collectively, “Materials”) are proprietary and protected by copyright, trademark, and other intellectual property laws.

You may not, without prior written permission:

• copy, reproduce, republish, upload, post, transmit, scrape, or distribute any Materials

• resell, license, or commercially exploit any templates, formats, frameworks, or written materials

• create derivative works based on our Materials, including “reworded” versions of templates, frameworks, or documentation formats

• remove copyright notices, trademarks, or branding

• use our Materials to build, train, seed, or populate another product, tool, database, software, or AI system

We reserve the right to suspend or terminate access for suspected unauthorized use and to pursue legal remedies, including injunctive relief and damages, to the fullest extent permitted by law.

Trademarks

BA Light Wellness™, Body Notes™, Body Literacy™, and related names, logos, product names, and taglines are proprietary identifiers of BA Light Wellness™ (Dr. Clara Ray). Unauthorized use that is likely to cause confusion or imply affiliation is prohibited.

 

9) DMCA Copyright Notice and Takedown Requests (U.S.)

If you believe copyrighted material on this website infringes your rights, you may submit a DMCA notice to support@balightwellness.com
with the subject line: DMCA Takedown Notice.

Your notice must include:

identification of the copyrighted work claimed to be infringed

identification of the material you claim is infringing, with enough detail to locate it (URL(s) and screenshots if available)

your name, address, telephone number, and email address

a statement of good-faith belief that the use is not authorized by the copyright owner, its agent, or the law

a statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner

your physical or electronic signature

If you believe material was removed in error, you may submit a counter-notice consistent with DMCA requirements.

Reporting Misuse of BA Light Wellness™ Materials

To report suspected copying, resale, scraping, or unauthorized derivative use of Body Notes™, Body Literacy™, or BA Light Wellness™ materials, email support@balightwellness.com
with subject line: IP Infringement Report and include links, screenshots, platform name, and account identifiers.

10) Privacy and Data Handling

We do not require users to create accounts or logins for Body Notes™ through our website. BA Light Wellness™ does not store user-entered Body Notes™ content on BA Light Wellness™ servers. Access and tool delivery may occur through third-party platforms, and data handling may be governed by those providers’ terms and privacy policies.

Your use of the Services is also governed by our Privacy Policy (linked in the website footer).

11) Disclaimers

The Services are provided on an “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet every user’s needs, prevent harm, or result in any specific outcome.

12) Limitation of Liability

To the fullest extent permitted by law, BA Light Wellness™ and Dr. Clara Ray shall not be liable for indirect, incidental, consequential, special, or punitive damages, or for loss of data, loss of profits, or loss of business, arising out of or related to your use of the Services.

Where liability cannot be excluded, liability is limited to the amount you paid to access the Services in the 30 days prior to the event giving rise to the claim.

13) Indemnification

You agree to indemnify and hold harmless BA Light Wellness™ and Dr. Clara Ray from claims, liabilities, damages, and expenses (including reasonable attorney fees) arising from:

• your misuse of the Services

• your violation of these Terms

• your documentation or sharing of information you were not authorized to record or disclose

• your professional use outside your scope or policy requirements

14) Termination

We may suspend or terminate access to the Services if you violate these Terms, misuse the platform, or create risk. You may stop using the Services at any time. Provisions regarding intellectual property, DMCA, disclaimers, limitation of liability, indemnification, and governing law survive termination.

15) Changes to These Terms

We may update these Terms from time to time. The “Effective Date” will reflect the latest revision. Continued use of the Services after changes means you accept the updated Terms.

16) Governing Law and Venue

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts located in Tulsa County, Oklahoma, unless otherwise required by law.
